The Kaiser Gypsum Asbestos Personal Injury Trust (the “Trust”) was established in 2021 as part of the Third Amended Joint Plan of Reorganization of Kaiser Gypsum Company, Inc. and Hanson Permanente Cement, Inc., dated as of May 30, 2019 (the “Plan”) by Kaiser Gypsum Company, Inc. and Hanson Permanente Cement, Inc. (collectively, the “Settlors”).
As provided in and required by the Plan and the Kaiser Gypsum Asbestos Personal Injury Trust Agreement, the Trust was created to process and pay valid Asbestos Personal Injury Claims in accordance with the Kaiser Gypsum Asbestos Personal Injury Trust Distribution Procedures (the “TDP”). The Trust aims to provide fair, equitable, and substantially similar treatment for all claimants.
The TDP sets forth the procedures for claimants to file claims with the Trust. Under most circumstances, claimants must first assert their claims against Settlors in the tort system. Service of process on Settlors should be effectuated pursuant to the rules of procedure applicable to each particular claim. Settlors’ registered agents are as follows:

For most claims, a claimant may file a claim with the Trust only after the claim has been fully and finally resolved in the tort system. Under some circumstances, which are set forth in the TDP, a claimant may file a claim with the Trust without first resolving his or her claim in the tort system. Claimants are encouraged to review the TDP carefully to determine the proper procedure for his or her claim.
